ARTICLE 02 - PURCHASE AND ORDER TAKING

The site www.petales-de-roses.com contains a commercial proposal for the sale of products, which is not legally considered as a permanent offer. 

Taking an order on pétales-de-roses.com implies the opening of a customer account that includes two identifiers: your e-mail and a password, to be chosen when creating your account. These identifiers are confidential. Do not lose them. The right of access to your identifiers can be made on simple request to our customer service, which will respond only by e-mail to the mailbox used for your customer account pétales-de-roses.com. 

Your order is definitively registered once you have validated your payment. The conclusion of the contract of sale will take place only if we accept this order. Indeed we reserve the possibility of not recording a payment and thus not confirming an order, in particular for the following reasons: problem concerning the received order (ex: abnormal, illegible) or delivery requested out of the planned zone.

You are held responsible for your order. Indeed, the data that you give us commit you once the order has been placed. In case of error in the wording of the recipient's details, we disclaim any responsibility for the inability to fulfill the order.

ARTICLE 03 - MODIFICATION OR CANCELLATION OF ORDER

You have the possibility to change the delivery information or to cancel your order until you receive the confirmation e-mail of your order. After this period, any modification or cancellation of the order by the buyer will be impossible. The order will not be refunded in any case if the delivery is effective.

In addition, orders for products in reservation are accepted and recorded once payment has been validated. Any cancellation will be impossible once your order has been validated. If a request for cancellation of an order for a product in reservation is formulated, only a credit note will be granted.

ARTICLE 04 - CHARACTERISTICS OF OUR PRODUCTS

The products that we offer on www.petales-de-roses.com are described in the product sheets containing a photo and indicating their particularities, the number of rose petals composing the boxes of 1 kg, as well as the colors of the roses. However these photographs are not contractual, Pétales-de-roses only taking the commitment to deliver products similar to those ordered. 

Product offers are valid while stocks last. In the hypothesis of a confirmed and settled order, and in case of stock shortage, Pétales-de-roses reserves the right to deliver petals or roses with identical characteristics in size and quality, having previously informed the customer by phone or by e-mail. 

Our petals of roses are guaranteed 4 days provided that the storage advice is respected, that is to say to keep them well in the cool during these 4 days. This guarantee cannot be invoked in the event of delivery carried out with a delay which is imputable to you (erroneous or incomplete address, absent recipient, etc).

ARTICLE 05 - PAYMENT

The payment is made cash when ordering, only by credit card (CB, Visa, Eurocard, Mastercard ...) using a secure payment technology SSL and / or SET. 

Payment is also accepted by check or bank transfer. In this case, the order is accepted only when the check or transfer is received on our account.

The debit on the credit card is made in euros only, when we accept your order, the debit time depends on the credit card and the bank.

ARTICLE 06 - DELIVERY

The products offered for sale on www.petales-de-roses.com are deliverable in metropolitan France only, to the address you have indicated when ordering.

Mode and delivery times 

Depending on the type of product ordered and the desired delivery area, you will have the choice between different modes of transport:

Express delivery by Chronopost or France Express in the provinces and Paris.

Delivery by So Colissimo with an average delay of 2 working days from the expedition of your package.

 

This delivery time is indicated for information only and is not contractual.

An e-mail confirming the dispatch of your order is sent to you when the products have been handed over to our carrier. This e-mail is sent to you for information purposes only to enable you to track the status of your order. Depending on the mode of transport chosen, you can follow the progress of the delivery in the section "my account - order history".

In the event of non-delivery or late delivery, Pétales de roses.com cannot be held responsible. The responsibility of the carrier alone will be effective. Please make the reserves with reception if need be. 

 

No order to the DOM TOM is accepted. The shipping costs indicated are calculated according to the country specified on the delivery address. 

Please note that during the period from October 15 to November 10, due to the very large number of orders to be shipped and depending on the dates of pulling out the roses from the fields so that they are of very good quality, delivery times are longer than expected. We thank you for your understanding.

 

Delivery delay 

Delivery times are met as precisely as possible. In the event that a delay in delivery would be due to an out-of-stock condition or to the transport of the products, this one cannot give rise to damages and rose petals cannot be held responsible. 

In case of error or omission in the wording of the delivery address preventing its realization as well as in case of refusal of the package by the recipient, the delivery will not be less perfect. Pétales-de-roses could be brought to propose you a commercial gesture to remedy these cases. 

You must make sure of the good availability of the recipient at the scheduled delivery times and do not hesitate to give us a maximum of indications that could facilitate the task of the deliveryman (Floor, door code, guardian, appearance of the place of delivery, access modalities, etc.). 

- Colissimo delivery: in case of absence, the deliveryman will leave a delivery notice in the recipient's mailbox, provided that it is accessible and identifiable. The recipient must then come and collect his bouquet at the address specified on the delivery notice within 15 working days. 

In case of absence of the recipient, Pétales-de-roses cannot be held responsible for the final quality of the delivery.

Attention, over the period from October 15 to November 15, given the very large number of orders to be shipped and depending on the dates of pulling out the roses from the fields so that they are of very good quality, the delivery times are longer than expected. We thank you for your understanding.

ARTICLE 07 - COMPLAINT

You have two days, following the indicative date of delivery, to make complaints about the product delivered. 

These claims will be subject to a prior attempt at amicable resolution. As such, we undertake to do our best to bring you satisfaction. Under no circumstances can there be damages or interest exceeding the amount of the order. The resumption of the plants depending on the care given on arrival, soil preparation, planting, weather conditions, we cannot guarantee their resumption. Exhausted varieties will be replaced in similar sizes and varieties unless otherwise specified. 

Any reimbursement will be made within a maximum of 21 days if you paid for your order by credit card and 60 days if you paid for your order by check. An e-mail will then be sent to you to notify you of the completion of your order.

ARTICLE 08 - FORCE MAJEURE

The responsibility of Pétales-de-roses.com cannot be engaged if the non-fulfillment of the contract is delayed or prevented due to force majeure such as war, riot, fire, strikes, accidents and the impossibility to be supplied. 

Similarly, Pétales-de-roses.com cannot be held responsible for interruptions of the site or intrusion by third parties on the site, as a technical event beyond its will and control.

ARTICLE 09 - MODIFICATION AND INTERRUPTION OF THE SERVICE

Pétales-de-roses.com reserves the right to modify, temporarily interrupt all or part of these services for technical reasons or compliance without prior notice to the consumer.

ARTICLE 10 - CANCELLATION FOR CONTRACTUAL FAULT OF THE CUSTOMER

In case of non-compliance with these general conditions of sale, Pétales-de-roses.com reserves the right, without any compensation or notice, to surprise or close the user's account and to deny future access to all or part of the service, without prejudice to the various criminal or contractual actions under common law that may be open to him.

If one or more of the provisions of these general conditions are held to be invalid, the other stipulations will retain all their force and scope.

ARTICLE 14 - TAKE-BACK GUARANTEE

We cannot guarantee the resumption of the supplied plants, not being masters neither of the plantation, nor of the maintenance, nor of the climate. The councils of culture are proposed as an indication, they are the fruit of our own experience; they can vary according to the conditions of culture and could not constitute a guarantee of success. The fact of placing order implies the whole adhesion of the purchaser to the conditions of sale. The articles mentioned on our website do not imply in an absolute way their availability. The price may be subject to change if economic fluctuations occur during the sales season.
